Legal Notice and Terms of Use

Below are the conditions for access and use of the website and the mobile application that must be known by the USER for the purposes provided for in Law 34/2002 on Information Society Services and Electronic Commerce (LSSI).

1. PURPOSE OF THE WEBSITE AND THE APP

Through the website chatmetric.app and the Chatmetric app, a service is offered that allows for the analysis of conversations and the reception of statistics from them. This service is exclusively directed at individuals over 18 years of age.

The service may include its own and/or third-party advertising and sponsorships, provided they comply with current regulations and these Terms of Use.

2. ACCESS AND USAGE CONDITIONS

Access and use of the website and the Chatmetric app is the exclusive responsibility of the USER and implies full and unreserved acceptance of these Terms of Use, as well as the other legal policies published on the website (Legal Notice, Privacy Policy, and Cookie Policy). Only individuals over 18 years of age may access and use this service. By using the website or the app, the USER represents and warrants that they are at least 18 years old.

SOLUCIONEC reserves the right to make, at any time and without prior notice, any changes or modifications it deems appropriate to the presentation, configuration, and contents of the website or the app, as well as to these Terms of Use.

2.1 OBLIGATION TO MAKE CORRECT USE OF THE WEBSITE, THE APP, AND THE CONTENTS
The USER agrees to use the website, the app, and the utilities provided in accordance with the law, this Legal Notice, the instructions and notices communicated to them, generally accepted morals and good customs, and public order.

The USER undertakes to use the service exclusively for lawful and non-prohibited purposes, which do not infringe current legislation and/or could be harmful to the legitimate rights of SOLUCIONEC or third parties, and/or could cause any direct or indirect damage or harm.

In particular, the USER agrees not to use the website, the app, or its contents for:
- Fraudulent and/or abusive use of the service.
- Transmitting or disseminating content that is contrary to fundamental rights and public freedoms, or that incites criminal actions or actions contrary to the law, morals, or public order.
- Incorporating or sharing content that infringes the intellectual or industrial property rights of third parties without authorization.
- Introducing viruses, malicious code, or any other physical or electronic element that could damage or prevent the normal functioning of the website, the app, or third-party computer equipment.
- Attempting to access, modify, or use restricted areas of the service, accounts of other users, or SOLUCIONEC systems through intrusion techniques (hacking) or other illegitimate means.
Likewise, the USER agrees not to reproduce, copy, distribute, make available, or publicly communicate the contents of the website or the app without authorization from the holder of the corresponding rights, nor to remove or manipulate the technical protection or rights identification measures incorporated into such contents.

2.2 INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS
The USER is obliged to respect the intellectual and industrial property rights of SOLUCIONEC and any other third party. Access to the website or the app does not imply, under any circumstances, the assignment of rights over trademarks, trade names, logos, texts, images, videos, software, or any other protected content.

It is expressly prohibited to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or subsequent publications, upload files, send by email, transmit, use, process, or distribute in any way all or part of the contents included in chatmetric.app or in the Chatmetric app, without the express written authorization of SOLUCIONEC or, where applicable, the holder of the corresponding rights.

2.3 DURATION OF THE SERVICE
Upon registering on the chatmetric.app website or Chatmetric app, the USER generates an account to which the information necessary for the provision of the service is linked (for example, history of analyzed conversations and billing data, where applicable). The account will remain valid indefinitely as long as the USER does not request its cancellation and provided that they comply with these Terms of Use.

The price of the service (when a paid part exists) will be as indicated at all times in the app or on the website, and may vary according to current promotions or offers. Failure to pay the corresponding amounts may result in the temporary suspension of the service associated with the account until the situation is regularized. SOLUCIONEC does not guarantee the permanent availability and continuity of the functioning of the website or the app. When reasonably possible, prior notice of planned interruptions will be given. Access may be suspended without prior notice to those USERS who breach these Terms of Use, without prejudice to the exercise of the corresponding legal actions.

2.4 EXCLUSION OF LIABILITY
SOLUCIONEC makes maximum efforts to keep the contents and the correct operation of chatmetric.app and the Chatmetric app updated; however, it cannot guarantee the absence of technical errors, service interruptions, or the absolute accuracy of the results of the analyses performed.

Consequently, any liability for damages of any nature derived from, among others, the following is excluded:
- The interruption of operation or the lack of availability of access to the website or the app.
- The transmission of viruses or harmful elements, when caused by third parties.
- The use that USERS make of the service, especially regarding the results of the analyses performed.
- The incorrect display, variation, or loss of data stored by the USER on their own devices or accounts.

Nothing stated in these Conditions limits or excludes liabilities that cannot be excluded under applicable law.

3. USE OF COOKIES

SOLUCIONEC may use its own and third-party cookies on chatmetric.app to facilitate navigation, remember preferences, and obtain statistical information about the use of the site. 4. PROTECTION OF PERSONAL DATA

Personal data provided by the USER through chatmetric.app or the Chatmetric app will be processed in accordance with the provisions of Regulation (EU) 2016/679 (GDPR) and other applicable regulations. Before providing their data, the USER will be informed of the purposes and legal bases for processing and must expressly accept the corresponding privacy policy. 5. LEGISLATION AND JURISDICTION

These Terms of Use are governed by Spanish legislation. For the resolution of conflicts, the parties submit to the Courts and Tribunals of Las Palmas de Gran Canaria, expressly waiving any other jurisdiction that may correspond to them.

6. WAIVER

The fact that SOLUCIONEC does not exercise at any given time any of its rights derived from these Terms of Use shall not be understood as a waiver thereof, unless recognized and agreed upon in writing.
